Please read these Terms of Service ("Terms") carefully before using the Two Passports mobile application or website (collectively, the "Service") operated by Two Passports ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Service and that they have reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at twopassportsapp@gmail.com if you suspect any unauthorized access to or use of your account. We are not liable for any losses or damages arising from your failure to safeguard your account.
You may not create an account on behalf of another person without their authorization, or use another person's account without permission.
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree not to:
- Use the Service in any way that violates applicable local, national, or international laws or regulations
- Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Infringe or misappropriate the intellectual property, privacy, or other rights of any third party
- Attempt to gain unauthorized access to any part of the Service, its servers, or any systems or networks connected to the Service
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Use automated tools, bots, scrapers, or crawlers to extract data from the Service
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
- Use the Service for any commercial solicitation or advertising without our prior written consent
We reserve the right to remove any content and suspend or terminate any account that violates this section, at our sole discretion.
You retain full ownership of all content you create, upload, or share through the Service, including photos, trip notes, and group information ("Your Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, reproduce, and display Your Content solely for the purpose of operating and providing the Service to you.
You represent and warrant that you own all rights in Your Content or have obtained all necessary permissions to grant us the license above, and that Your Content does not violate any third-party rights or applicable laws.
You are solely responsible for Your Content. We do not endorse, verify, or assume any liability for content submitted by users.
Two Passports offers a free tier and an optional premium subscription ("Two Passports Premium"). Subscription pricing is displayed in the App Store or Google Play at the time of purchase and may vary by region.
- Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective billing terms and conditions
- Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date
- You can manage or cancel your subscription at any time through your device's app store account settings
- We do not offer refunds for partial subscription periods, except where required by applicable law. All refund requests for App Store purchases must be directed to Apple; all refund requests for Google Play purchases must be directed to Google.
- We reserve the right to change subscription pricing. We will provide advance notice of any price changes through the app or via email.
The Service and all of its content, features, and functionality — including but not limited to the name "Two Passports," our logo, design, text, graphics, and software — are owned exclusively by Two Passports and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.
"Two Passports" and our logo are proprietary marks of Two Passports. You may not use our name, logo, branding, or any confusingly similar marks in connection with any product, service, or for any commercial purpose without our prior express written permission.
Nothing in these Terms transfers any intellectual property rights to you. The limited license granted to you under these Terms does not include the right to sublicense, sell, resell, transfer, or otherwise exploit the Service or any of our intellectual property.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no guarantees regarding the accuracy, reliability, or completeness of any content within the Service.
Your use of the Service is at your sole risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TWO PASSPORTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOST PROFITS, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total cumulative liability to you for any and all claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months immediately preceding the claim, or (b) fifty U.S. dollars ($50).
Some jurisdictions do not allow the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless Two Passports and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or for any other reason at our sole discretion. You may delete your account at any time via Settings → Delete Account within the app.
Upon termination for any reason, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 4, 6, 7, 8, 9, 11, and 12) will remain in effect.
Informal resolution. Before initiating any formal legal proceeding, you agree to contact us at twopassportsapp@gmail.com and give us at least 30 days to resolve the dispute informally.
Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in New Jersey, or remotely if permitted by the AAA rules. The arbitrator's award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
Class action waiver. You agree to resolve any disputes with us on an individual basis only. You waive your right to participate in any class action lawsuit or class-wide arbitration against Two Passports.
Exceptions. Nothing in this section prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. To the extent arbitration does not apply, you agree to submit to the exclusive jurisdiction of the state and federal courts located in New Jersey for the resolution of any disputes.
If you download the Service through the Apple App Store, the following additional terms apply:
- These Terms are an agreement between you and Two Passports only — not with Apple, Inc. Apple has no responsibility for the Service or its content.
- Apple has no obligation to provide maintenance, support, or warranty services for the Service.
- In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service.
- Apple is not responsible for addressing any claims you or any third party may have relating to the Service, including product liability claims, consumer protection claims, or intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, where changes are material, notify you via the app or email. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Two Passports regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
